Equestria LA Terms of Service
By accessing and using this website and/or attending the event (“Equestria LA 2017″ or “the Event”), you accept and agree to be bound by the terms and provision of this agreement (“this TOS”). In addition, when using this website’s particular services (“the Services”), you shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into the TOS. This TOS shall be governed by the laws of the State of California, and does not supersede any law written in that jurisdiction.
Any participation in this site will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this site or attend Equestria LA 2017.
We reserve the right, at our sole discretion, to modify or replace any of the terms or conditions of this TOS at any time. It is your responsibility to check this TOS periodically for changes. Your continued use of the Services following the posting of any changes to this TOS constitutes acceptance of those changes. If any change to this TOS is not acceptable to you, your sole remedy is to cease accessing, browsing and otherwise using the Services and not to attend Equestria LA 2017.
Equestria LA 2017 is an event occurring at the Wyndham Anaheim Garden Grove (“the Venue”) at 12021 Harbor Boulevard, Anaheim, CA 92840, USA from November 17, 2017 through November 19, 2017. This website provides information about the event, as well as a system (“Registration”) for collecting payments from people (“Attendees” or “you”) who wish to attend. The event and website are maintained by Alicorn Inc., the event organizers and planners, their officers, directors, employees and agents (“the Organizers”). Attendees can use the website to find information about the Event, and use Registration to reserve attendance at the Event. This TOS applies to everyone who uses the Services of the website and/or to all Attendees of the Event.
Your Use of the Services
You are authorized to use the website and its services to get information about the Event and register to attend using Registration. This authorization extends to you, and is not transferrable to anyone else. All activity on the website and at the Event must be in compliance with this TOS. You may only use the Services through a web browser designed to work with any website. All other access is expressly forbidden, except if given written authorization from the Organizers. You shall not, and shall not permit anyone else to, directly or indirectly, (i) modify, reproduce or otherwise create derivatives of any part of the Services or Site Content (as defined below); (ii) reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or structure, sequence and organization of all or any part of the Services (except that this restriction shall not apply to the limited extent restrictions on reverse engineering are prohibited by applicable local law); (iii) rent, lease, resell, distribute or use the Services for timesharing, service bureau, or commercial purposes; (iv) remove or alter any proprietary notices or labels on or in the Services or Site Content; (v) engage in any activity that interferes with or disrupts the Services; or (vi) engage in any fraudulent activity or activity that facilitates fraud.
If you are allowed to download or use any Software in connection with the Services, the Organizers hereby grant you a personal, non-transferable, non-sublicensable, revocable, non-exclusive license to use the Software solely for your internal use in connection with the Services, and only in accordance with this TOS and the written instructions/directions (if any) provided by the Organizers in conjunction with the Software. For purposes of this TOS, “Software” shall mean any and all software that is available on or through the Site or otherwise provided by the Organizers. For clarity, the Software will be deemed a part of the “Services” hereunder.
The Software and the transmission of applicable data is subject to United States export controls. No Software may be downloaded or otherwise exported or re-exported in violation of U.S. export laws. Downloading or using the Software is at your sole risk. You shall also be responsible for using the Software in a manner that complies with all federal, state and local laws and the rules and regulations of all credit card companies.
The Software and related documentation are “commercial computer software” and “commercial computer software documentation,” respectively, as such terms are used in United States Federal Acquisition Regulations Section 12.212. Any use, duplication or disclosure of the Software or such documentation by or on behalf of the U.S. Government is subject to restrictions as set forth in this TOS.
This website provides a system for registering to attend (acquiring a membership for) Equestria LA 2017. Registration offers different tiers of service with different prices (membership dues), as listed on the Registration website. The Organizers will make a best-faith effort to provide the level of service offered on the Registration site, but make no guarantees of providing service for any reason. Any credentials issued providing access to the Event (“Membership”) are licensed, not sold, to you solely for the purposes of attending the Event. The Organizers may revoke any Memberships to the Event for any reason, deemed solely at their discretion, issued via spoken word, written word, or email, without expectation of a refund issued. If your Membership is revoked, you agree to immediately return your Membership to the Organizers and immediately leave the Event premises.
At the discretion of the Organizers, the Registration system may accept certain codes in exchange for discounts (“Coupon Codes”). Coupon Codes are not eligible to be applied to transactions that have already been completed. The Organizers do not offer any means of partial refunds if Memberships are purchased at a higher rate than is possible later due to a Coupon Code.
As part of Registration, the website will ask for pieces of personally identifying information (“PII”). It is your responsibility to provide accurate information and keep it up to date through Registration. Providing incorrect PII may lead to your Membership being revoked at the discretion of the Organizers. The Organizers will only be providing pre-purchased Memberships at the Event if the PII is verifiable through the use of government-issued photo identification.
In general, the Organizers will not be providing refunds for any reason. The Organizers may, at their sole discretion, decide to offer a refund for exceptional circumstances. Should the Organizers decide to issue you a refund, your Membership will be immediately invalidated and must be remitted as noted in the Registration section of this TOS. The refund will not exceed the amount paid. The Attendee further agrees that once the registration and payment are submitted, this agreement is a legally binding and enforceable obligation of the Attendee.
If an event for which a membership has been purchased is cancelled, due to any reason, the Organizers will make every effort to equally distribute available funds to Membership holders up to the cost of their membership. Full refunds are not guaranteed or likely should this unfortunate situation arise. Members will receive refunds after the total available funds are determined and all relevant legal and contractual matters are settled, including but not limited to insurance payouts and reparations from the Venue. If Event merchandise is pre-purchased before the event and that merchandise is not available for distribution at the Event a full refund will be given in the amount of the merchandise price to the purchasing Attendee.
In the event of a dispute between Attendees and Organizers, the Attendee agrees to make a best-faith effort to contact the Organizers through information on the website to resolve the dispute. The Organizers will attempt to resolve the dispute through the rules and information laid out on this website and in this TOS. Should the Attendee seek outside remediation of the dispute, any communication/information shared with the Organizers will be made available for remediation at the discretion of the Organizers.
The Organizers will use commercially reasonable efforts to hold the Event. However, under no circumstances will the Organizers be held responsible for unavailability caused by circumstances beyond Business’ reasonable control, including acts of god, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes or other labor problems nor can any reservation be cancelled, altered or amended once the Event has commenced on the basis of circumstances beyond the Organizers’ reasonable control.
Limitation of Warranty and Liability
The Organizers reserve the right to amend and change any part of the Event at any time. The Organizers accept no liability for damages of any nature sustained by Attendees or accompanying persons, or loss of, or damage to their personal property as a result of the Event or related events. The Organizers accept no liability of any Attendee’s inability to attend. The Organizers accept no liability for actions taken by any Attendee in the course of the Event.
Attendees are responsible for their own safety and security at the Event. Attendees are solely liable for any actions they take during the Event that may cause harm or damage to Attendees, the Organizers, the Venue, the Event, or their respective property.
The Attendee understands and agrees that their participation in and attendance at the Event is knowing and voluntary. The Attendee understands and agrees that strict observation of the Event rules and regulations is required and that use of the Event facilities and the Attendee’s presence at the Event are at the sole risk of the Customer. The Attendee indemnifies and holds harmless the Organizers from and against any claims, demands, actions, liabilities, damages, costs or expenses, including court costs and reasonable attorneys’ fees arising out of or relating to: (i) the Attendee’s participation in the Event; (ii) claims against the Organizers by any third parties arising from or related to the Organizer’s actions and/or omissions, (iii) claims relating to any violation or alleged violation by the Organizers and/or any third party of the applicable laws relating to the conduct of the Event; and/or (iv) claims arising from or relating to the Organizers’ performance of its obligations hereunder. The Attendee specifically understands and agrees that they are assuming the risk of any and all injuries that they may suffer or incur as a result of their registration and/or participation in the Event. The Attendee’s indemnification obligations shall survive the expiration or termination of this agreement.
